Under Persecution In Your Home Country?

If you or a loved one has undergone persecution or threats in your home country – or if you fear persecution if you would return – the United States government allows you to apply for asylum in the U.S. no matter what your immigration status, provided you meet certain criteria. The persecution must stem from your nationality, ethnicity, political opinions, religion, or your membership in a persecuted social group. Additionally, you will need to provide a sworn statement that explains why you left your home country and the reasons that you are afraid to return there. It’s a scary position to be in – and that’s why our immigration attorney will stay by your side throughout the process, doing all we can to keep you safe from the situation in your home country that brought you to the U.S. in the first place. Don’t wait. Book your free consultation with our compassionate immigration lawyer today.

Understanding Your Rights Under VAWA

VAWA offers special protections for victims of domestic violence, sexual assault or exploitation, stalking or other forms of abuse or mistreatment from their partner/former partner/spouse/family member who is either a U.S citizen or lawful permanent resident (LPR). This includes providing eligibility for lawful permanent residence through self-petitions filed with U.S Citizenship & Immigration Services (USCIS). To qualify under this program you must meet certain criteria including being an LPR or noncitizen victim who has been abused by a U.S citizen or LPR spouse/parent/child/sibling; having good moral character; residing with abuser; being present in U.S when filing petition; having suffered battery/extreme cruelty; having entered marriage in “good faith” etc.

Protecting Yourself Through Humanitarian-Based Immigration Applications

The Asylum program offers similar protections but requires different criteria than VAWA petitions such as whether you meet refugee eligibility requirements established by Congress; whether persecution has occurred based on your race, religion, nationality etc.; whether you can show credible fear; whether you meet good moral character standards set by Congress etc.; whether you committed a serious criminal offense; whether there is reasonable possibility you will suffer future persecution if returned home etc.. At The Law Office of Vaneskha Hyacinthe, Esq. we provide detailed information about all aspects related to asylum cases so that our clients are able to make an informed decision when applying for asylum status in the United States.
